On 20 October 2022, an adviser (Advocate General) to the European Court of Justice (ECJ) recommended that the ECJ uphold the European Commission (ECappeal )’s of a 2020 General Court (GC) verdict that overturned the EC’s ban on Three and O2’s UK merger.
By raising the EC’s hurdle to prohibit transactions in markets with a few significant players, the GC’s opinion was perceived as favoring consolidation in the telecoms sector and beyond.
